GENERAL TERMS OF USE OF THE WEBSITE WWW.FIRENZEROCKS.IT
Preamble and Use of the Website
The following general terms of use (“General Terms”) apply to the use of the website www.firenzerocks.it and the Firenze Rocks App (individually, the “Website” and “Firenze Rocks App”; collectively, the “Platforms”) by users (“User/Users”).
Pursuant to and for the purposes of Article 7 of Legislative Decree no. 70 of April 9, 2003, Users are hereby informed of the following: the service provider governed by these General Terms is Live Nation Italia S.r.l., with registered office at Via Pietrasanta, 14, 20141 Milan, Tax Code and VAT no. 03320430964, email address: info@livenation.it (“Controller” or “Live Nation”).
The Platforms are intended to allow Users who register to purchase tickets in advance for the Firenze Rocks festival (hereinafter, the “Event”) through the websites www.ticketmaster.it and www.ticketone.it, to enable Users who consent to receive, via email and/or app notifications, information related to the Event and/or newsletters and/or promotional communications about initiatives organized and/or services offered by the Controller, to allow participation in prize promotions organized by the Controller or its commercial partners, and to enable users of the Firenze Rocks App, subject to consent, to receive location-based notifications about nearby Events (hereinafter, collectively the “Services”).
The User agrees to use the Platforms and Services solely for lawful purposes and in any case in compliance with laws concerning the protection of personal data and intellectual property.
Live Nation reserves the right to verify, at any time and without notice, at its sole discretion, that the User complies with these General Terms, and may, at its sole discretion, exclude any User who does not comply.
2. Suspension of Services
Live Nation reserves the right to suspend or terminate, permanently or temporarily, at any time and without notice, the provision of the Services if the User:
– has failed to provide updated, complete, truthful, and correct personal data;
– uses or has used the Platforms for unlawful purposes or in ways deemed by the Controller to be incompatible with the nature of the Services provided (e.g., transmission and/or exchange of viruses; sending or sharing personal advertisements; chain letters or pyramid schemes; spamming or junk mailing practices; transmission and/or distribution of illegal material or content that is racist, defamatory, threatening, vulgar, or obscene);
– violates or has violated the General Terms or the specific terms and conditions applicable to the Services.
Live Nation also reserves the right to interrupt the Services for system maintenance or updates to its own or third-party IT systems, keeping Users informed via email, updates on the Platforms, or messages within the Services.
Live Nation disclaims all liability for damages, claims, or losses, direct or indirect, arising from malfunctions of the User's or third-party equipment, or from telecommunication links not directly managed by the Controller or its providers.
3. Links to Other Websites
The Platforms may contain hyperlinks to third-party websites, including advertisements and content providers. These sites may collect data or request personal information from the User. Live Nation does not control, nor is it required to control, these links or sites and therefore disclaims any responsibility for damages, claims, or losses, direct or indirect, arising in any way from the viewing, use, and/or functioning of such third-party sites or services accessed via those links.
4. Duration and Termination
The Services are provided for an indefinite period unless terminated in accordance with the following terms.
The User may terminate the contract at any time by sending an email to the Controller’s address indicated above.
5. Amendments to the General Terms
Live Nation reserves the right to amend these General Terms, as well as the terms and features of the Services, at any time by publishing a general notice to Users on the Platforms. The changes shall take effect no earlier than 10 days after the date of the notice.
Users agree to print or save the General Terms and all subsequent amendments on a durable medium.
6. Copyright and Trademarks
Except for spidered content, all contents of the Platforms – including but not limited to texts, trademarks, logos, icons, images, illustrations, audio-video recordings, databases, source code or software, patents – are protected by Italian copyright law (Law no. 633/41) and the Industrial Property Code (Legislative Decree no. 30 of February 10, 2005), and are the property of Live Nation or third parties and/or Users who manage them under license or authorization, including through the Users themselves.
Except for personal use, the User may not copy, modify, alter, publish, publicly promote, distribute, sell, or transfer any material and/or content (including articles, images, videos, databases, software strings) found on the Website, in whole or in part, without the written consent of Live Nation.
By accessing the Platforms, the User agrees to the following conditions:
– not to reproduce pages or frames of the Website;
– not to exploit the name of the Platforms and/or Live Nation;
– not to reproduce articles, texts, materials, or links from the Platforms for commercial purposes.
Specifically, the User agrees not to:
– use the Platforms in a way that could cause damage or infringe on the rights of others;
– use software or programs that could harm the Platforms;
– change, alter, or modify the “Look and Feel” of the Platforms.
7. Governing Law and Jurisdiction
These General Terms are governed by Italian law.
Any dispute relating to these General Terms shall be submitted to the court of the place where the User has their residence or domicile, if located in the territory of the Italian State.
8. Personal Data
The privacy policy and cookie policy are considered integral parts of these General Terms and are accessible in the Privacy and Cookie Policy section of the Website.
These General Terms have been in effect since November 14, 2017.
